This paper discusses issues related to the inclusive education. According to the Brazilian Constitution, the access to education is everyone’s right. To this end, historical and conceptual changes occurred until this right was guaranteed to people with special educational needs. Therefore, in this work, there is a brief historic background on the Brazilian legislative process in relation to special education. Subsequently, the main concepts of this educational policy and its objectives are discussed herein and a reflection is made on the work of music therapy within this context.
